My Moto - Terms and Privacy Notice

Please note the following terms and privacy notice apply when you register for a My Moto account.

Please note the following terms and privacy notice apply when you register for a My Moto account:

  1. You must be aged 18 or over in order to create a My Moto account.
  2. We ask for the following details when you initially register for your My Moto account:
    • Your name and email address as confirmation of your identity, to enable you to verify your account and to enable us to contact you where you have requested this and/or where we are required to do so;
    • Your creation of a password to protect your My Moto account and to enable you to login;
    • Which key customer group you belong to (business, HGV, coach or leisure), so that when you login to your account you will be directed to content on our website or app which is tailored to your customer group.
  3. After your initial registration, you have the option to add the following details:
    • Your favourite brand(s), your favourite location(s) and/or your favourite journey(s), so that when you login to your account you will be directed to content on our website or app, which is tailored to your favourite brand(s), your favourite location(s) and/or your favourite journey(s).
    • An option to sign up to receive our electronic marketing, so we can send you offers and promotions via email; where you have added your key customer group, your favourite brand(s), your favourite location(s) and/or your favourite journey(s) we may send you more personalised offers and promotions.   
    • An option to sign up to receive, via email, surveys of your experiences at Moto, and the opportunity to enter prize draws.

      If you sign up to receive (i) electronic marketing; and/or (ii) to receive customer research communications, including surveys and prize draws; the Electronic Marketing and Customer Research Terms and Privacy Notice will apply.
  4. Where you provide us with your information via your My Moto account registration, you are giving us your consent to use it for the purposes indicated above. Please note that whenever you login to your account you will have the option to control your marketing and survey preferences, to opt in or opt out at any stage; to update your favourite location(s), journey(s) or brand(s); and/or to delete your My Moto account.
  5. We will also process your information, as it is in our legitimate interests to do so, for our analytics purposes, including to study our customers’ use of our products and services, to enable us to develop them, to grow our business and to inform our marketing strategy, and to create aggregated, anonymous data, from which individuals cannot be identified. We may also use your data for other purposes which are legally required or permitted (which may include our requirements to maintain records and/or where it is necessary for the establishment, exercise or defence of legal claims).
  6. Where you open a  My Moto account, your details will be stored together with other customer interactions you may have, or have had, with us, including where you have submitted feedback and/or contacted customer services, and where you have signed up to receive electronic marketing and/or customer research communications, such as surveys and prize draws. This is to allow Moto to respond more effectively to its customers, including in relation to queries and feedback and the exercise of customers’ data rights.
  7. Your My Moto account will remain active for 36 months from the date of your most recent interaction with Moto, which may be via a My Moto login, the submission of feedback or customer research responses to Moto, and/or where you open/respond to any marketing emails/communications.  After this time, we will send you an email to ask you whether you wish your My Moto account to be retained or deleted. If you do not respond to us within 14 days, then we will automatically delete your My Moto account, and you would need to create a new account, if required. Where your My Moto account is deleted you will no longer receive any electronic marketing  or customer research communications. Please note that we may, however, retain records where we are legally required or permitted to do so (which may include where you have contacted customer services with feedback and/or to request a specific response – please see the Feedback and Customer Services Contact Terms and Privacy Notice).   
  8. We will not generally share your details with third parties, except for our data processors, who may process the data on our behalf, where we have entered into an appropriate agreement with them. However, we may, on occasion, share your data with third parties, such as external advisers or insurers, if this is necessary in relation to any claims and/or where we are legally required or permitted to do so.
  9. Your personal data will be stored by our data processor, Hubspot, which may process some data outside the EEA/UK. The data processing agreement that applies between Hubspot and Moto can be found here: https://legal.hubspot.com/dpa.
  10. When you login to your account you will have the option to update your data and/or to delete your account. You can also ask us for access to the data we hold about you, or to rectify or erase your personal data or in some circumstances to restrict our processing of your data. 
  11. Please note that our website terms and conditions apply to the extent applicable in relation to your use of the My Moto account.
  12. The Data Controller to whom you are providing your details is: Moto Hospitality Limited, Toddington Service Area, Junction 11/12, M1 Southbound, Toddington, Bedfordshire, LU5 6HR. Moto is committed to protecting and respecting your privacy.   13. If you have any complaints about the way in which your data is being processed, please contact us at: dataprotection@moto-way.co.uk. You also have the right to contact the Information Commissioner’s Office (the UK’s information supervisory authority). 
  14. Moto may update these terms and privacy notice at any time. The updated version will be available on our website.
